This Week’s Update

The Senate passed two Congressional Review Act (CRA) measures: one to overturn the United States Fish and Wildlife Service rule reclassifying the northern long-eared bat as endangered under the Endangered Species Act (ESA) (S.J.Res. 24) and one to overturn the National Marine Fisheries Service rule that rescinded a final rule establishing a regulatory definition for the term “habitat” under the ESA (S.J.Res. 23), both by a vote of 51-49, short of the two-thirds threshold needed to override an expected veto by President Biden. The Senate also passed the NOTAM Improvement Act of 2023 (H.R. 346) and confirmed nominations.

  • House – The House passed the Secure the Border Act of 2023 (H.R. 2) by a vote of 219-213 and the Protecting Taxpayers and Victims of Unemployment Fraud Act (H.R. 1163) by a vote of 230-200.

Next Week in Congress

  • Senate – The Senate will reconvene on Monday, May 15, and will resume considering nominations. The Senate may consider the DC policing CRA (H.J.Res. 42), the Public Charge CRA (S.J.Res. 18), and the nomination of Julie Su to be Secretary of Labor.
  • House – The House will reconvene on May 15. The House may consider the POLICE Act of 2023 (H.R. 2494) and the Federal Law Enforcement Officer Service Weapon Purchase Act (H.R. 3091).
