House

 

Yesterday:

  • Call to Order: The Chair, under clause 2 of rule 1, found that the House was not in a state of order due to the presence of Members in the well who were not under recognition. The Chair asked Members to leave the well so that the House could proceed with business.
  • Recess: The House recessed at 12:03 p.m. and reconvened at 10:04 p.m.
  • Decorum Statement: The Speaker made the following announcement regarding decorum in the House Chamber: ”The Chair appreciates that Members will differ on matters of policy and will seek to express those differences. But the Chair would hope that the business of the House could be conducted in a fashion that reflects positively on the dignity and decorum of this institution to which we all belong and serve.”.
  • Disapproving the rule submitted by the Department of Labor relating to the definition of the term ”Fiduciary”–Presidential Veto: The House voted to sustain the President’s veto of H.J. Res. 88, disapproving the rule submitted by the Department of Labor relating to the definition of the term ”Fiduciary”, by a yea-and-nay vote of 239 yeas to 180 nays, Roll No. 338 (two-thirds of those present not voting to override), after the previous question was ordered by a recorded vote of 229 ayes to 175 noes with two answering ”present”, Roll No. 337.
  • Subsequently, the veto message (H. Doc. 114-140) and the bill were referred to the Committee on Education and the Workforce.
  • Recess: The House recessed at 10:31 p.m. and reconvened at 12:58 a.m. on Thursday, June 23, 2016.
  • Motion to Fix Next Convening Time: Agreed to the Sessions motion that when the House adjourns on the legislative day of Wednesday, June 22, 2016, it adjourn to meet at 2:30 a.m. on Thursday, June 23, 2016, by a recorded vote of 234 ayes to 166 noes, Roll No. 339.
  • Motion to Adjourn: Agreed to the Sessions motion to adjourn by a recorded vote of 234 ayes to 173 noes, Roll No. 340.

  • Commerce, Justice, Science, and Related Agencies Appropriations Act–Agreement: Senate continued consideration of H.R. 2578, making appropriations for the Departments of Commerce and Justice, Science, and Related Agencies for the fiscal year ending September 30, 2016, taking action on the following amendments proposed thereto:
    • Pending:
      • Shelby/Mikulski Amendment No. 4685, in the nature of a substitute.
      • McConnell (for McCain) Amendment No. 4787 (to Amendment No. 4685), to amend section 2709 of title 18, United States Code, to clarify that the Government may obtain a specified set of electronic communication transactional records under that section, and to make permanent the authority for individual terrorists to be treated as agents of foreign powers under the Foreign Intelligence Surveillance Act of 1978.
      • McConnell motion to recommit the bill to the Committee on Appropriations for a period of 14 days.
    • During consideration of this measure today, Senate also took the following action:
      • By 58 yeas to 38 nays (Vote No. 108), three-fifths of those Senators duly chosen and sworn, not having voted in the affirmative, Senate rejected the motion to close further debate on McConnell (for McCain) Amendment No. 4787 (to Amendment No. 4685) (listed above).
    • Senator McConnell entered a motion to reconsider the vote by which cloture was not invoked on McConnell (for McCain) Amendment No. 4787.
    • A unanimous-consent agreement was reached providing for further consideration of the bill at approximately 10:30 a.m., on Thursday, June 23, 2016.
