  • Measures Considered:
  • Federal Water Quality Protection Act–Agreement: Senate began consideration of the motion to proceed to consideration of S. 1140, to require the Secretary of the Army and the Administrator of the Environmental Protection Agency to propose a regulation revising the definition of the term ”waters of the United States”.
  • A motion was entered to close further debate on the motion to proceed to consideration of the bill, and, in accordance with the provisions of rule XXII of the Standing Rules of the Senate, and pursuant to the unanimous-consent agreement of Friday, October 30, 2015, a vote on cloture will occur at 2:30 p.m., on Tuesday, November 3, 2015.
  • A unanimous-consent agreement was reached providing that at approximately 10 a.m., on Tuesday, November 3, 2015, Senate resume consideration of the motion to proceed to consideration of the bill, with the time until 12:30 p.m. equally divided between the two Leaders, or their designees; that the Senate recess from 12:30 p.m. until 2:15 p.m. to allow for the weekly conference meetings; and that notwithstanding the provisions of rule XXII, the vote on the motion to invoke cloture on the motion to proceed to consideration of the bill occur at 2:30 p.m., Tuesday, November 3, 2015, with the time from 2:15 p.m. until 2:30 p.m. equally divided in the usual form.

  • Bipartisan Budget Act: By 64 yeas to 35 nays (Vote No. 294), Senate agreed to the motion to concur in the amendment of the House of Representatives to the amendment of the Senate to H.R. 1314, to amend the Internal Revenue Code of 1986 to provide for a right to an administrative appeal relating to adverse determinations of tax-exempt status of certain organizations, after taking action on the following motions and amendments proposed thereto:
    • Rejected:
      • McConnell motion to concur in the amendment of the House of Representatives to the amendment of the Senate to the bill, with McConnell Amendment No. 2750, to change the enactment date. (Senate tabled the motion.)
    • During consideration of this measure today, Senate also took the following action:
      • By 63 yeas to 35 nays (Vote No. 292), three-fifths of those Senators duly chosen and sworn, having voted in the affirmative, Senate agreed to the motion to close further debate on McConnell motion to concur in the amendment of the House of Representatives to the amendment of the Senate to the bill.
      • McConnell motion to refer the amendment of the House of Representatives to the amendment of the Senate to the bill, to the Committee on Finance, with instructions, McConnell Amendment No. 2752, to change the enactment date, fell when cloture was invoked on McConnell motion to concur in the amendment of the House of Representatives to the amendment of the Senate to the bill.
      • McConnell Amendment No. 2753 (to (the instructions) Amendment No. 2752), of a perfecting nature, fell when McConnell motion to refer the amendment of the House of Representatives to the amendment of the Senate to the bill, to the Committee on Finance, with instructions, McConnell Amendment No. 2752 (listed above) fell.
      • McConnell Amendment No. 2754 (to Amendment No. 2753), of a perfecting nature, fell when McConnell Amendment No. 2753 (to (the instructions) Amendment No. 2752) (listed above) fell.
      • By 64 yeas to 35 nays (Vote No. 293), three-fifths of those Senators duly chosen and sworn, having voted in the affirmative, Senate agreed to the motion to waive all applicable sections of the Congressional Budget Act of 1974 and applicable budget resolutions with respect to the House Message. Subsequently, the point of order that the House Message reallocates payroll taxes between the retirement and disability Social Security trust funds, was not sustained, and thus the point of order fell.
      • McConnell Amendment No. 2751 (to Amendment No. 2750), of a perfecting nature, fell when McConnell motion to concur in the amendment of the House of Representatives to the amendment of the Senate to the bill, with McConnell Amendment No. 2750 (listed above) was tabled.
